Terms and Conditions
PLEASE READ THE FOLLOWING HEALTH CHOICES GLOBAL REFERRAL PROGRAM TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN THE PROGRAM. PARTICIPATION IN THIS PROGRAM CONSTITUTES YOUR ACCEPTANCE OF ALL THE PROGRAM TERMS AND CONDITIONS.
We are excited that you have chosen to participate in the HEALTH CHOICES GLOBAL referral program. Your participation in and use of the program is strictly subject to the program terms and HEALTH CHOICES GLOBAL's terms. If you have any questions, please feel free to contact us.
Participant Acceptance and Termination
We can and will make all determinations regarding participation in the Health Choices Global program. We reserve the right to terminate your participation in the program at any time for any reason or no reason, to the extent permitted by law, upon written notice to you. Any written notices required or permitted hereunder may be delivered by email to your registered email address. By participating in the program, you consent to the delivery of all program-related notices and information by email to the email address you have registered with, and acknowledge that you have the necessary equipment (hardware and software) to receive such emails. Qualified Referrals and Payment
Qualified referrals must (i) be new customers to Health Choices Global: for purposes of the program, “new customer” does not include either (1) a person who is a current or pending customer (2) a person who was a customer within the 30 days immediately prior to the date a referral email invitation was sent to that person; (ii) satisfy all enrollment requirements; (iii) enroll online by linking to the website using the personal link generated by the referral program (enrollments from emails or links not generated by the Program are not eligible for bill credits); (iv) remain enrolled for at least 90 consecutive days; and (v) have “cookies” enabled on the computer from which the enrollment is executed. Eligible participants will be issued a commission for each qualified referral. The amount of such commission will be determined based upon the current offer at the time of the applicable qualified referral’s enrollment. The commission amount offered may be changed at any time prior to enrollment of a qualified referral without notice to you or your referrals. The referral program page on the Health Choices Global website will contain up-to-date information regarding the current offered amount. Such commission will be distributed on a quarterly basis as soon as the qualified referral has met all requirements. By participating in the program, you agree that we shall make the final determination as to whether any referral meets all requirements to be considered a qualified referral. From time to time, there may be limited-time promotions which provide for increased incentive payments. They are subject to change without notice to you by updating the information on the referral program page on the Health Choices Global website.
Program Use
Health Choices Global will provide you with access to the program, which you may use to track your referrals and payment determinations with respect thereto; provided, that your use of the program is strictly subject to the Program Terms. Health Choices Global will update the program with your account information periodically, including setting forth the email addresses to which you have sent an enrollment request email and whether a particular referral is a qualified referral. We are not obligated to and will not release to you the reasons why a particular referral has not been deemed a qualified referral.
UK Data Protection Act 2018, the General Data Protection Regulation (GDPR), and other applicable data protection laws
Health Choices Global complies with the UK Data Protection Act 2018, the General Data Protection Regulation (GDPR), and other applicable data protection laws. We respect your right to privacy and are committed to ensuring the confidentiality and security of your personal data. As such, we expect you to comply with applicable data protection laws and regulations when participating in our program. We also honor requests from consumers and customers who choose to opt-out of receiving marketing emails from us, and we expect you to do the same.
Confidentiality
In connection with your participation in the Health Choices Global program, you may receive confidential and proprietary information belonging to Health Choices Global, including sensitive customer data ("Information"). You will maintain all such information in strict confidence and use the Information only in connection with your participation in the program. Notwithstanding anything to the contrary contained herein, you agree that you will comply with all applicable data protection laws and regulations regarding the handling and protection of confidential information.
Independent Contractor Relationship
Your participation in the Health Choices Global program does not grant you any authority to act on behalf of our business, its parent company, or any affiliated entities. This agreement does not create or imply an employer-employee relationship, joint venture, partnership, or association between you and Health Choices Global or any affiliated entities. As a participant in the program, you acknowledge that you are acting as an independent contractor and assume any risks associated with this status. Health Choices Global does not have the right to direct or control how you perform your obligations under this agreement.
Trademarks
Other than the materials provided to you in connection with your participation in the program, you are not authorized to use any trademarks, copyrighted materials, patents, names, logos or other intellectual property owned or licensed by Health Choices Global, its parent company, or any of their respective affiliates.
Indemnification
By participating in the program, you agree to and will indemnify and hold our business, its parent and their respective affiliates harmless from and against any and all damages, costs, expenses, claims or liabilities of any kind, including third party claims, whether pending or threatened, including without limitation, attorneys’ fees and court costs, incurred by any of them arising out of or related to your participation in the program or breach of these Program Terms.
Warranty Disclaimers; Limitation of Liability
Your participation in the program is at your own risk. The program is provided to you "as is" without any warranty, whether express or implied. We, Health Choices Global, and our parent company, along with our respective affiliates, disclaim all warranties, including without limitation, any warranties of merchantability or fitness for a particular purpose.
In no event shall we, Health Choices Global, our parent company or any of our respective affiliates be liable for any special, indirect, consequential or incidental damages or damages for loss of profits, revenue, use, or data, whether in contract, negligence, or other legal theory, arising out of or in connection with these program terms or the program, even if we have been advised of the possibility of such damages. Our total liability for any claims arising out of or in connection with these program terms or the program will be limited to the amount paid by you, if any, to participate in the program.
Warranty Disclaimers; Limitation of Liability
YOU ACKNOWLEDGE AND AGREE THAT YOUR PARTICIPATION IN THE PROGRAM IS ENTIRELY AT YOUR OWN RISK. THE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. HEALTH CHOICES GLOBAL, ITS PARENT COMPANY OR ANY OF THEIR AFFILIATES DO NOT MAKE ANY WARRANTIES OR REPRESENTATIONS REGARDING THE PROGRAM, AND EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS.
IN NO EVENT SHALL HEALTH CHOICES GLOBAL, ITS PARENT COMPANY, OR ANY OF THEIR AFFILIATES BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, USE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH THESE PROGRAM TERMS OR YOUR PARTICIPATION IN THE PROGRAM. THIS LIMITATION OF LIABILITY APPLIES WHETHER THE CLAIM IS BROUGHT IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL LIABILITY OF HEALTH CHOICES GLOBAL, ITS PARENT COMPANY, AND THEIR AFFILIATES ARISING OUT OF OR IN CONNECTION WITH THESE PROGRAM TERMS OR YOUR PARTICIPATION IN THE PROGRAM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO HEALTH CHOICES GLOBAL IN CONNECTION WITH YOUR PARTICIPATION IN THE PROGRAM.
Amendments
The terms of the program may be amended by Health Choices Global at any time by providing notice to you. If you continue to participate in the program after being notified of the changes, you will be deemed to have accepted the changes.
Other Terms and Conditions
These Program Terms are supplementary and do not in any way limit or modify Health Choices Global's other terms and conditions or agreements that allow you to participate in the program and/or use Health Choices Global's MyAccount.
Acceptance and Jurisdiction
By participating in the Health Choices Global program, you confirm that you have read, understood, and accepted these Program Terms, and agree to be bound by them. These Program Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Program Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of England and Wales. By participating in the program, you consent to the jurisdiction of such courts.
General
You may not transfer your participation in the program to any other party. Health Choices Global may assign or delegate any of its rights or responsibilities under these Program Terms to independent contractors or third parties. Health Choices Global shall not be considered to have waived any of its rights or remedies unless such waiver is in writing and executed by an authorized representative of Health Choices Global. Delay or omission by Health Choices Global in exercising any rights or remedies shall not operate as a waiver of such rights or remedies or any other rights or remedies. A waiver on one occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions. All rights reserved.
Advertising Standards Authority (ASA) and the European Advertising Standards Alliance (EASA).
Under UK and European laws, Health Choices Global complies with the guidelines set forth by the Advertising Standards Authority (ASA) and the European Advertising Standards Alliance (EASA). If you make any posts on any social network (such as Facebook, Twitter, Instagram, Pinterest, or LinkedIn) as part of this program, you must ensure that your posts comply with the guidelines set by the ASA and EASA, and any other applicable laws, statutes, and regulations.
If you are making a post that includes a testimonial or endorsement, you must clearly disclose any material connections you have with Health Choices Global, such as receiving compensation or other incentives. You must make this disclosure in a prominent and easily understandable way in the same post as the testimonial or endorsement. Failure to do so may result in a breach of advertising regulations.
You are responsible for ensuring that your posts on any social network comply with the terms of use of the site and any other applicable laws, statutes, and regulations. Health Choices Global shall not be held responsible for any non-compliance with such laws and regulations by you.
